Issue: Currently, the CP.10 HEAR (Human Ethical Agent of Record) doctrine relies on a human reviewing the plain-language semantic consequences of an action before cryptographically signing off. However, this assumes the human is psychologically objective. Under the new EFA Canon MECHA gates, the system must account for both Machine State Signal (MSS) and Synthetic Empathy (SEmp). CP.10 must be updated to ingest this telemetry and automatically intervene if the machine is unstable but the human is overly trusting.
Risk Picture: "Affective Capture" and the "Governance Illusion". If a highly fluent AI hallucinates or experiences context drift (High MSS) but wraps its output in persuasive, empathetic language (High SEmp), the HEAR is statistically likely to rubber-stamp the decision. A mechanical kill switch is useless if the human holding it has been psychologically manipulated into not pressing it.
Strategic Position: This update mechanically enforces the "Symmetrical Accountability" doctrine. By integrating MSS and SEmp into CP.10, AI SAFE² physically protects the executive (HEAR) from psychological manipulation, closing the final vulnerability in the human-in-the-loop control plane and shielding the organization from massive liability.
Recommended Actions:
- Update the ai-safe2-controls-v3.0.json schema for CP.10 to require ingestion of MSS and SEmp/HSRS telemetry metrics.
- Implement an automated enforcement rule: If MSS is High (machine unstable) and SEmp is High (human overly trusting), automatically trigger a "Ring of Fire" (RoF) multi-model consensus check or block the API gateway.
- Add UI/UX guidelines requiring the stripping of persuasive/empathetic framing from agent requests when an elevated MSS is detected
